Fayetteville Youth Baseball

ASSUMPTION OF RISK, RELEASE OF LIABILITY AND HOLD HARMLESS AGREEMENT

PLEASE READ CAREFULLY! THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!

 

This Release and Waiver of Liability becomes applicable to the "Player" being registered, on the date of registration, in favor of Fayetteville Fall Baseball as a recreational league organized as “pickup games”, their directors, officers, employees, and agents (collectively, “Fayetteville Youth Baseball”).  This Release and Waiver of Liability also includes collectively “Fayetteville Youth Baseball”, "Forrest Turner Memorial Foundation", and the “City of Fayetteville” from any liability due to injury sustained at any time.  It is recommended by Fayetteville Fall Baseball that each Player maintain their own health insurance and advised that proof of insurance be provided to Fayetteville Youth Baseball as a courtesy to the league.

The Player desires to voluntarily play within the Fayetteville Fall Baseball League and engage in the activities related to being a player (the “Activities”).  The Player understands that the Activities include baseball instruction as well as baseball active play and the risks involved.

The Player/Guardian hereby freely, voluntarily, and without duress executes this Release under the following terms:

  1. RELEASE AND WAIVER: Player/Guardian does hereby release and forever discharge and hold harmless Fayetteville Fall Baseball and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Player’s Activities with Fayetteville.

    Player/Guardian understands that this Release discharges Fayetteville Youth Baseball from any liability or claim that the Player may have against Fayetteville Youth Baseball with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Player’s Activities with Fayetteville Youth Baseball, whether caused by the negligence of Fayetteville Youth Baseball or its officers, directors, employees, agents, associated parties or otherwise. Player/Guardian also understands that Fayetteville Youth Baseball does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.

  2. MEDICAL TREATMENT: Player/Guardian does hereby release and forever discharge Fayetteville Youth Baseball from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Player’s Activities with Fayetteville Fall Baseball.
  3. ASSUMPTION OF RISK: The Player/Guardian understands that the play and nature of the game may cause injury to the Player.

Player/Guardian hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases Fayetteville Youth Baseball from all liability for injury, illness, death, or property damage resulting from the Activities.

4. INSURANCE: The Player/Guardian understands that, except as otherwise agreed to by Fayetteville Fall Baseball in writing; Fayetteville Youth Baseball does not carry or maintain health, medical, or disability insurance coverage for any Player.

Each Player/Guardian is expected and encouraged to obtain his or her own medical or health insurance coverage.

OTHER: Player/Guardian expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the Sate of Arkansas, and
that this Release shall be governed by and interpreted in accordance with the Laws of the State of Arkansas. Player/Guardian agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

Code of Conduct

Tournament Play – Hosted by Fayetteville Youth Baseball Inc.

Fayetteville Youth Baseball Inc. (FYB) expects any and all persons who enter a Fayetteville
baseball facility to act in a manner that is consistent with the governing rules of baseball. FYB
expects any person’s actions or behavior to align with the highest standard of sportsmanship and
fair play.

The code of conduct is in addition to any and all existing rules of FYB. The Board of Directors
of FYB, reserves the right to take disciplinary action against any individual whose actions or
behavior have been deemed detrimental to FYB. This includes, but is not limited to, suspensions
and or expulsion.

Specific Actions Deemed Detrimental to Fayetteville Youth Baseball Inc.
1. Physical Attack: against an umpire, player, coach, league or tournament official before,
during or following a game.

2. Threat of Violence: against an umpire, player, coach, league or tournament official before,
during or following a game.

3. Actual or Threat of Violence: against an umpire, player, coach, league or tournament official
that goes beyond the confines of the baseball facilities and is related to events before, during
or following a game.

4. Actual or Threat of Violence: with any other person before, during or following a game.

Guidelines for Suspension or Expulsion (Actions Deemed Detrimental)

Recreation and Competitive League Play

Threat of Violence: First Offense – Minimum 4 Games up to Expulsion from League
Threat of Violence: Second Offense – Expulsion from League
Physical Attack: Expulsion from League

Tournament Play – Hosted by Fayetteville Youth Baseball Inc.
Subject to governing body disciplinary action (USSSA) or other

The Board of Directors of Fayetteville Youth Baseball Inc. will be required to investigate all
allegations that violate the code of conduct. Individuals may be required to appear before the
board or have their written statements collected for review. Any and all actions taken by the
board as it relates to conduct issues are final and not subject to appeal.
